TERMS OF SERVICE for COMMISSIONED WORKS
First off, thanks for your interest in having me do a custom work! We’ve put together a comprehensive set of price/ground rules for you to review so you know what to expect during and after the creation process. It's a formidable wall of text, but we felt it was necessary to make sure both parties know what's expected of each other before committing!
In general, there are 2 distinct quality levels that I provide to clients (for private use) to accommodate a range of budget levels:
This is the basic digital pencil sketch. Pick this option if you’re looking for a rough, unpolished look with a rawer energy.
Single Character Sketch - starts at $45
Additional Characters/Bodies - starts at $20 per
Example Works in this tier:
My highest output level, usually reserved for my print gallery and the convention circuit.
Single Character with color (or rich greytone) rendering - starting @ $75
Additional characters/bodies START @ $45 per
** Some Notes on my Drawing Ability **
I’m not so good at creating robots and vehicles from scratch.
I don’t specialize in furry/anthropomorphic styles, but I’m willing to learn :)
I prefer to keep content at or below PG-13 for the most part, and I likely won’t draw anything with extreme gore/violence or sexually explicit imagery. If you're looking for anything beyond PG-13, please mention this in the form field below.
So there's no misunderstanding, if you're wanting several poses of the same character (for example, someone that is surrounded by clones of themselves), each one of those poses counts as a separate 'body' on the page and will be charged accordingly.
Lastly, I’m not available to do any comic/sequential art.
And if you haven’t already, I urge you to peruse my galleries here on the website to see what kind of subject matter I typically deal in!
You can add a Background Element for a fee that varies with complexity of the background. Sometimes just a quick splash of accent color is all you need to nicely cap off a picture, in which case I may not charge anything. Any requests beyond that will be appraised as we come to them.
Some possible character/background combos:
Other Variable Factors on Price
1. Intricate Costume Detail Fee
There may be an additional charge for characters with a high amount of intricate detail/costuming, such as outfits with Victorian/steampunk designs or densely mechanical suits. The pricing will be considered on a case by case basis.
2. Price Discount
Conversely, there may be a price reduction for a character if say, a disproportionately small part of them features in the composition. For example, adding in a small pet cat would not necessarily be a full price character add-on, unless the cat features prominently--such as being very large in comparison with other subjects on the page. That being said, small scale does not necessarily equal small price. If a character only takes up 3 inches of a 17 inch tall composition, but the character is just as detailed as a larger scale character in the same piece, then it will be priced accordingly. The main factor is how MUCH of that subject is shown. A full body pose will typically cost a higher price than just a head peeking out from behind other characters!
3. Photorealism Fee
While it is very time and resource intensive, I can produce portraits of you or your friends (or pets) that stay true to whatever photographs you provide me. As it is sometimes difficult to perfectly nail a person’s exact likeness, there is a surcharge involved with this level of quality. However, depending on my schedule I may not be able to accommodate the workload, so I do it rarely.
4. Revision Fee:
The creation method is a back and forth process! With each major step of the project I will be continuously sending you a snapshot of my work to get your approval before moving forward. In order to make the process as smooth as possible for both of us, I ask that you you make any requests for major changes up front during the sketching phase. Major changes include facial expressions, body positioning (arm or leg revisions), head turns, etc. It’s a bummer to be 5 to 10 hours into a project only to find out that I need to re-ink and re-paint a section of it due to something that should have been conveyed earlier, you know? :) That being said, if you only need me to change a color or darken something, that will be no cost.
If you do need to request an emergency change after the initial sketch period, I’ll do my best to accommodate you at no charge. But if you continue to request more changes later on into the inking and painting phase, I will have to request additional payment for the added workload before continuing.
5. Commercial Use Fee, or Transferral of Copyright
If the work you commission is intended for commercial use and not for private enjoyment, or if you choose to own the copyright, an additional fee will be added on. See details below.
Expected Completion Schedule:
Ideally, a single character commission can be completed within a week. You will be notified before purchase if I have a lot of other projects going at the same time. This may slow your commission down by another 2-4 weeks depending on what I've got on my plate. If you have a very strict deadline for your commission, let me know before work begins!
I will get progress emails out to you for approval as often and as quickly as possible. Timely responses are very helpful in the completion of your commission!
Payment and Refund Policy:
I would prefer payment in full by the time of the project’s start. Alternatively, you can pay a portion to reserve your spot in line if I can’t get to your order right away.
Paypal is the preferred method of payment for online orders (I will send you an invoice if I take on a contract with you), but if we meet in person at a convention, then we can do cash/credit/debit. In this case, I will draft and send an email to you as a record of payment.
Sorry, but NO REFUNDS on completed work!. If at the initial revision stage it is decided that things are not going to go the way you had in mind, a partial refund will be sent to you, allowing a minimum of $15-$25 to myself for the sketchwork done, depending on complexity and completion of the sketches sent.
If you paid in advance and work has not been started yet, a full refund will be returned to you if you decide you no longer want the commission or if circumstances prevent me from giving your project the necessary time.
Copyright and Intent to Sell Completed Work
I’ve been drawing all my life and selling my works at fan conventions since 2006, and very recently I discovered that I could quit my day job of 9 years and support my family on just art income alone. It really has been awesome to be able to say that I chased down my dream and actually didn’t go broke while doing it! So what I’m trying to say is, my craft is my livelihood. And after completing production of your custom art, I may want to add it to my gallery as a future print to sell. In other words, I retain the copyright of the image to reproduce, edit, print, or upload to online galleries.
Obviously, if I painted a picture of you, your friends, or your original characters, you retain the ownership rights of the characters depicted in the work, and I would not be allowed to create future works with those likenesses without your permission.
That being said, if you are not square with the idea of me selling prints of the completed work after I put in the time to get it exactly how you want, then I have to levy a commercial licensing fee of at least $200 per completed work. So if it comes down to this, please let me know before we sign off on starting the commission.
